Trump’s team caught Ilhan Omar flat-footed with one court-approved move

Few members of Congress get under President Trump’s skin quite like Ilhan Omar.

Democrats figured nobody would dare touch her with the midterms bearing down.

But one federal judge finally signed off, and the agents who showed up came ready.

Federal Agents Arrive at Ilhan Omar’s Door With a Judge’s Blessing

Homeland Security Investigations agents recently carried out a search warrant at the Washington-area home of US Representative Ilhan Omar (D-MN), according to three people briefed on the matter who spoke with the New York Times.

The warrant lists a string of possible immigration crimes, the Times reported, including false statements and fraud on immigration paperwork, plus a general conspiracy count.

And this was no rubber stamp. Prosecutors first submitted the application more than a week before agents arrived, and the judge approved it only after a back-and-forth over constitutional questions tied to Omar’s status as a sitting member of Congress, including the speech or debate clause.

A Justice Department spokeswoman confirmed that HSI agents, who operate under ICE, executed a judicially authorized search tied to an “ongoing federal criminal investigation.” She declined to say more.

Nobody has charged Omar with anything. She denies any wrongdoing, and every claim against her remains an allegation until a court says otherwise.

But Omar wasted no time going on offense. She called the search “an attempt to target political enemies and weaponize federal law enforcement.”

“For ten years, Trump has targeted me with baseless lies and smear campaigns. This is just the latest escalation in his campaign of political intimidation,” Omar wrote on social media, adding, “I will not be silenced.”

Trump didn’t exactly tiptoe around it either. Speaking to reporters before a campaign rally in Ohio, the President said, “I understand they’re looking at her very carefully.” He kept going: “She comes from a country that is a non-country. And then she comes over here and she complains about our Constitution.” Then he told reporters the decision rests with the Justice Department.

The Decades-Old Paperwork That Could Change Everything

The roots of this case stretch back to the mid-1990s. Omar’s family fled Mogadishu as civil war tore through Somalia, spent time in a Kenyan refugee camp, and eventually won admission to the United States as refugees. They settled in Minnesota.

Investigators reportedly zeroed in on Omar’s late father, Nur Omar Mohamed, and whether he lied or left information out when he sought legal status before becoming a citizen. One question on the table, according to a person familiar with the case, is whether Omar derived her own citizenship from a father who may not have qualified for naturalization.

And that matters a great deal. If the Justice Department turns up conclusive evidence, prosecutors could pursue a criminal or civil denaturalization case. A judge who orders someone denaturalized can open the door to deportation proceedings.

Homeland Security Secretary Markwayne Mullin said in September that his department was digging into the family’s immigration history and suggested deportation could be the end result. A DHS spokesperson put it bluntly: “No one, including members of Congress, are above the law.”

Vice President JD Vance went further in March, telling a conservative podcaster, “We actually think that Ilhan Omar definitely committed immigration fraud.” Vance said the next step was to “build a case necessary to get some justice for the American people.”

White House border czar Tom Homan told Newsmax late in 2025 that statute of limitations problems had hamstrung earlier efforts, and he said he had no doubt Omar committed fraud. Those remain the views of Homan and Vance, not findings of any court.

And the scrutiny doesn’t stop at immigration forms. Federal investigators have reportedly also looked at Omar’s finances, her campaign funds, and her dealings with a foreign citizen. A financial disclosure covering 2024 listed Omar and her husband holding between $6 million and $30 million in assets, according to Fox News, though her office later claimed the filing overstated the family’s position because it relied on incomplete information.

Not bad for someone who spends so much time railing against the rich.

Democrats Suddenly Fall in Love With the 60-Day Rule

House Democrat leaders Hakeem Jeffries (D-NY), Katherine Clark (D-MA), and Pete Aguilar (D-CA) called the search a “rogue abuse of power.”

Their joint statement didn’t hold back: “The Trump administration’s raid on Congresswoman Ilhan Omar’s home is deeply disturbing and raises serious questions about the continued corrupt weaponization of the federal government against Donald Trump’s adversaries.”

Critics are pointing to an old Justice Department custom. Prosecutors generally avoid overt investigative steps within 60 days of an election when those steps could safely wait. Agents conducted this search 22 days before Election Day.

But the custom bends. It carries exceptions for cases where prosecutors fear evidence could disappear, crimes remain ongoing, or someone faces danger. And a federal judge spent more than a week chewing on this warrant before approving it.

Here’s where Democrat memories get a little hazy. Attorney General Merrick Garland hand-picked Special Counsel Jack Smith, and in September 2024, with the presidential race in full swing, Smith filed court papers laying out his evidence against Trump in the 2020 election case. Trump and his lawyers objected, citing the same 60-day principle. Smith’s allies insisted a court order required the filing, and Democrats were happy to leave it there.

That whole campaign season, Smith pushed constitutionally dubious charges toward show trials in Democrat-run Washington, DC, in an apparent bid to put Trump behind bars before voters had their say. His history of prosecutorial overreach, and the way his investigations swept up Republican officials, attorneys, and ordinary supporters, never seemed to bother the same Democrats now clutching their pearls.

So the rule is sacred when a Squad member’s house is involved. It was a mere technicality when the target was the Republican nominee for President.

Joe Biden’s Own Justice Department Had Questions Too

One detail should give Omar’s “smear campaign” line real trouble. The Biden administration’s Justice Department opened its own investigation into Omar in 2024, examining her finances, campaign spending, and interactions with a foreign citizen, according to the Times.

That’s Joe Biden’s Justice Department. Hardly a MAGA outfit.

Omar has fielded questions about her immigration history since her first run for the Minnesota Legislature in 2016. Earlier federal inquiries, including one into the longstanding claim that she married a sibling to help him get a green card, ended without charges. Omar has called that claim “absurd and offensive.”

But in September she assured supporters in a fundraising email, “I will say it again so it’s as clear as possible: I’m not at all worried about these investigations, because they are complete shams.” Agents holding a judge-approved warrant have a funny way of changing the mood.

Back in Minneapolis, supporters rallied in a park waving “Stand with Ilhan” signs. Minneapolis City Council member Jason Chavez predicted the search would fire up her base. “Folks are riled up,” he said. “What is happening is just wrong.”

Maybe so. Omar represents one of the bluest districts in the country and faced no serious challenger in her 2026 primary. Her seat looks plenty safe.

What deserves more attention is whether anybody in Washington ever seriously checked the refugee files of that era. This case could hinge on forms filed three decades ago. And if investigators show that a sitting member of Congress obtained citizenship through a process built on false statements, Americans will want to know how many other files nobody bothered to open.

For years, the federal government handed out legal status and never looked back. Now somebody is finally checking the work. And Democrats who spent a decade insisting nobody is above the law are about to find out whether they meant it.
