Democrats keep losing the biggest legal battles once they reach their endgame.

Their lawfare strategy runs out of steam after it moves beyond the courtrooms of rogue leftist judges.

And now the Supreme Court just dealt Democrats a gut-punch defeat they never saw coming.

Supreme Court Greenlights Trump Safe Third Country Deportation Program

The Supreme Court handed down an unsigned ruling allowing the Trump administration to continue to deport illegal aliens to safe third countries while the legal battle over the policy plays out.

Left-wing justices Sonya Sotomayor, Elena Kagan and Ketanji Brown Jackson dissented.

The court also announced it would hear oral arguments in this case in December.

But the court allowing the lynchpin of the Trump administration’s deportation effort to continue while the matter was pending was a good sign since if a majority of justices believed there was an irreparable harm by allowing an unconstitutional program to continue, it would have left a ruling in place from a lower court judge blocking the program from continuing.

Trump officials celebrated the ruling.

“Now for the second time, SCOTUS just granted our stay in conducting all third-country removals of illegal aliens,” Attorney General Todd Blanche wrote on X. “Again, this is entirely lawful and a critical tool for immigration enforcement. Unlike the lower court, SCOTUS waited to hear from both sides before making the decision.”

“A bad day for criminal illegals and open-borders activists alike,” Department of Homeland Security General Counsel James Percival posted to social media.

What the Third Country Deportation Program Is

One of the big roadblocks to deportations was that countries refused to accept the illegal aliens their governments dispatched to America.

The Trump administration devised a new policy where third-party countries would accept illegal aliens getting deported on the promise that they wouldn’t be subjected to torture or prosecution.

“The policy provided that migrants could be swiftly removed without notice to third countries that have provided credible diplomatic assurance that ⁠they will not persecute or torture the individuals. For countries that have not provided such assurance, deportees would be notified of their destination and US authorities would assess the likelihood of persecution or torture only if the individual raises such fear on their own,” Breitbart reported.

This policy was the foundation of mass deportation, and the lower court order was forcing the administration to keep violent criminal illegal aliens inside America.

“Solicitor General John Sauer had told the justices the policy was an essential tool for removing some of the worst criminal aliens, and that the lower-court block had forced DHS to scrap a flight carrying 70 deportees to three countries. Rubio’s State Department has struck agreements with up to 31 nations, mostly in Africa and Latin America, at a cost of at least $410 million pledged through the end of June,” KFGO reported.

The court’s signal that it will rule in favor on the merits of this policy is the news the administration and its supporters hoped to hear.
