Chuck Schumer just told his caucus that Donald Trump is coming to steal the midterms.
His party has spent months telling Americans that only Republicans refuse to accept a loss.
And Schumer just summoned one hired gun Democrats keep calling whenever a race won’t stay lost.
Schumer Wants a Concession From a Man Whose Name Isn’t on the Ballot
Senate Minority Leader Chuck Schumer (D-NY) used the final stretch of the midterm campaign to warn his caucus about a crime nobody has committed.
In a letter to his fellow Democrat Senators, Schumer announced a post-Election Day war room to guard against what he called efforts by Trump to “steal the election.” Democrats, he vowed, will fight “every step of the way.”
He laid out the plumbing, too. Schumer told Democrat Senators they would hear from party lawyer Marc Elias about “Trump’s suppression tactics and the legal response,” and a Democrat election task force would keep briefing the caucus as returns rolled in on Election Day.
Then Schumer wrote the sentence that matters most.
Trump “is directing a government-wide effort to prevent Americans from voting and to challenge any results he doesn’t like,” Schumer wrote. “We cannot just sit back and wait for him to concede. We need a unified team.”
Concede what, exactly? Donald Trump isn’t running for anything on Election Day. Every House seat and roughly a third of the Senate sit on the ballot, but the President’s name appears on none of them.
And in the very same letter, Schumer sounded downright cocky about his party’s chances. “It feels like the American people have had enough,” he wrote. A party that sure of a blowout doesn’t usually pour concrete for a legal bunker ahead of the morning after.
Schumer also passed around a post he wrote for Elias’ Democracy Docket website, claiming that Trump’s “campaign of subversion is well underway.” His proof came down to three items: the administration’s probe of the Alaska Senate campaign, Trump’s criticism of mail-in voting, and the search for noncitizens on the voter rolls.
Pennsylvania Already Ran the Schumer-Elias Playbook
Anybody wondering what a Schumer war room looks like in action doesn’t need to guess. Pennsylvania got a full demonstration in November 2024.
Republican Dave McCormick beat then-Senator Bob Casey (D-PA) by roughly 17,000 votes. The Associated Press called the race for McCormick within days of the election.
Casey wouldn’t budge. And Schumer, then the Senate Majority Leader, kept McCormick out of an orientation session for incoming Senators while Casey eyed a recount. Schumer didn’t reverse course until November 12.
Casey then brought in Marc Elias, the same lawyer Schumer just put on his Election Day speed dial.
What followed made national news. Bucks County’s Democrat commissioners voted to count undated and misdated mail ballots even though the Pennsylvania Supreme Court had ruled against counting them, and Commissioner Diane Ellis-Marseglia didn’t bother dressing it up.
“I think we all know that precedent by a court doesn’t matter anymore in this country,” she said. “People violate laws any time they want. So for me, if I violate this law, it’s because I want a court to pay attention to it.”
Casey had endorsed Ellis-Marseglia in her own race and attended a private fundraiser for her campaign. Her PAC, in turn, sent money to Casey’s reelection bid.
The state Supreme Court shut Bucks County down within days. Casey picked up a grand total of four votes in the first wave of a pricey recount he could have waived, and taxpayers got stuck with the bill. He finally conceded on November 21, 2024, about three weeks after the AP call.
Three weeks of the winner cooling his heels while the loser’s lawyers went hunting for ballots. Keep that picture handy the next time Schumer lectures anybody about concessions.
Marc Elias Has Walked This Road Before, and So Has Schumer
But Pennsylvania wasn’t the first time this duo showed up after the polls closed. In November 2018, Elias represented then-Senator Bill Nelson (D-FL) as Nelson trailed Republican Rick Scott through a statewide recount.
Elias told reporters that “we should all be able to agree that the goal here is a legal and accurate count.” Schumer joined Nelson in Washington, DC, and accused Trump of bullying Florida election officials. “It’s just plain wrong. It’s un-American,” Schumer said.
Scott won anyway. Nelson conceded after the recount, and Senator Rick Scott (R-FL) still holds that seat.
Elias’ courtroom record carries a few dents of its own. In March 2021, a Fifth Circuit panel sanctioned him and several Perkins Coie colleagues over what the court called a “redundant and misleading” motion in a fight to restore straight-ticket voting in Texas. Their clients in that case included the DSCC, the Senate Democrats’ own campaign arm. The judges found the lawyers had refiled a motion nearly identical to one the court already denied, without telling the panel. And when the court later let three of his colleagues off the hook, it kept the sanction on Elias.
President Trump has called Elias “a terrible lawyer with a horrible track record.” Elias likes to boast that he beat Trump and his allies “more than 60 times in court” after the 2020 election.
Funny thing about that scoreboard. Elias and his allies filed more than 200 lawsuits before that election on behalf of Democrat clients, many of them aimed at rewriting voting rules on the fly under cover of COVID. Then they spent the months afterward insisting nobody had any business asking questions about the outcome.
Democrats Built a Bunker and Called It a Watchdog
Schumer wants Americans to believe this war room exists to protect voters. Look closely at the targets he named, though.
Mail-in voting tops his list. Long before the issue split along party lines, the 2005 bipartisan Carter-Baker Commission, co-chaired by Jimmy Carter and James Baker, warned that “Absentee ballots remain the largest source of potential voter fraud.” Trump didn’t dream that worry up. A Democrat President helped write it down.
The noncitizen search comes next. Only American citizens can legally vote in federal elections, and checking the rolls against that standard is about as basic as election housekeeping gets. If scrubbing noncitizens off the rolls counts as subversion, Schumer is working from a strange definition of an honest election.
But the scariest scenario Democrats keep floating, ICE agents posted at polling places, has no plan behind it. Homeland Security officials have rejected the idea, and no order exists sending federal agents to stand guard over anybody’s ballot box.
Maybe the war room never files a single lawsuit. Maybe the task force spends Election Night eating takeout and watching returns like every other political junkie in America. But nobody hires Marc Elias for the takeout.
Elias said as much himself back in August. “This is not something that we wait until election subversion has taken place,” he told reporters.
Close Senate races are where this machine earns its fees. In a tight one, the lawyers already have their briefing, the talking points already exist, and the word “steal” already sits on paper before a single ballot gets counted.
And the stakes run well past one seat. A Senate majority would give Schumer the power to freeze Trump’s nominees for two years and bless every investigation House Democrats keep promising.
“Democrats aren’t going to sit back and hope for the best,” Schumer said in April when he unveiled his election task force. He has been repeating some version of that line ever since.
Chuck Schumer says Donald Trump is coming to steal the midterms. The last Senate fight in which an election official openly announced she might break the law to count ballots unfolded in Pennsylvania, for a Democrat who had Marc Elias in his corner. Somehow that one never made the list of threats in Schumer’s letter.
